MARK (Money App Re-invented, Kinda)
1. Acceptance of Terms
Welcome to MARK (Money App Re-invented, Kinda). By downloading, installing, or using the MARK mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and Chinmoy Dutta ("Developer", "we", "us", or "our").
Agreement to Privacy Policy
By accepting these Terms, you also agree to our Privacy Policy, which describes how we collect, use, and protect your personal data.
2. Eligibility
Age Requirement
You must be 18 years of age or older to use MARK. By using the App, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into this agreement
- You are not prohibited from using the App under Indian law or any other applicable law
Parental Consent
If you are under 18 years of age, you may not use this App under any circumstances. We do not knowingly collect information from individuals under 18.
Geographic Restrictions
MARK is intended primarily for users in India but is available globally. Users outside India must comply with their local laws regarding financial data management and app usage.
3. Service Description
MARK is a voice-enabled expense tracking application that provides the following services:
Core Features
- Expense Tracking: Record, organize, and analyze personal expenses and income
- Voice Input: Use voice commands to log expenses (offline or online mode)
- AI-Powered Categorization: Automatic expense categorization using machine learning
- Analytics & Insights: Monthly spending reports, budgets, and financial analytics
- Local-First Storage: Data stored primarily on your device
- Optional Cloud Backup: Backup to your personal Google Drive
- Multi-Currency Support: Track expenses in 50+ currencies
- Debt Tracking: Track borrowed and lent amounts
- Recurring Transactions: Manage subscriptions and recurring expenses
Premium Features & Subscription Tiers
MARK offers basic features on the Free tier and advanced features through subscription plans:
- Free Tier (Ad-Supported): Access to core local features, manual transaction entry, and basic local reports. To fund the free service, advertisements are displayed after every five transactions added by the user.
- Free Trial: New users can access premium features during a 7-day free trial period. No credit card is required.
- Essential (BYOK) Plan: A local-only premium subscription allowing ad-free local tools and direct voice/text parsing using your own API keys (Bring Your Own Key - BYOK) from Gemini or Groq. No cloud backup/sync is included.
- Pro Plans (Weekly, Monthly, Yearly Premium): Full access to all features including cloud backups/sync, advanced cloud-based AI voice parsing, and home screen widget previews.
Service Availability
We strive to provide uninterrupted service, but we do not guarantee that the App will be:
- Available at all times or in all locations
- Error-free or free of viruses or bugs
- Compatible with all devices or operating systems
- Uninterrupted or secure
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time.
4. User Accounts
Account Creation
To use MARK, you must create an account using Google Sign-In. By creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your Google account credentials
- Update your information to keep it accurate
- Notify us immediately of any unauthorized access to your account
Account Security
You are responsible for:
- All activities that occur under your account
- Maintaining the confidentiality of your Google account password
- Securing your device (screen lock, biometric authentication, etc.)
We are not liable for any loss or damage arising from your failure to secure your account.
One Account Per User
You may only create one account. Creating multiple accounts to circumvent trial limitations or abuse premium features is prohibited.
Account Deletion
You may delete your account at any time through Settings → Account → Delete Account. This action is irreversible and will permanently delete all your data.
5. User Responsibilities
Accurate Data Entry
You are solely responsible for:
- The accuracy of expense and income data you enter
- Reviewing and correcting AI-categorized transactions
- Backing up your data regularly (using CSV export or Google Drive backup)
- Complying with tax laws and financial regulations in your jurisdiction
Data Backup
While MARK stores data locally on your device and optionally in your Google Drive, you are responsible for maintaining your own backups. We are not liable for data loss due to:
- Device failure, loss, or theft
- Accidental deletion
- Software bugs or crashes
- Operating system updates or factory resets
Recommendation: Regularly export your data as CSV (Settings → Export Data) and store it securely.
Legal Compliance
You agree to use MARK in compliance with:
- All applicable Indian laws and regulations
- Tax reporting requirements (Income Tax Act, 1961)
- Anti-money laundering regulations (if applicable)
- Export control laws (if using internationally)
Appropriate Use
You agree to use MARK solely for personal expense tracking purposes. Commercial use, resale, or redistribution is prohibited without written consent.
7. Intellectual Property
Ownership
MARK and all its components, including but not limited to:
- Source code and software architecture
- User interface design and graphics
- Logos, branding, and trademarks
- Machine learning models and algorithms
- Documentation and tutorials
...are owned by Chinmoy Dutta and protected by Indian copyright and intellectual property laws.
Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal device
- Use the App for personal, non-commercial expense tracking
Restrictions
You may NOT:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter copyright notices or branding
- Sell, rent, lease, or sublicense the App
- Use the App for commercial purposes without written consent
- Extract or scrape data from the App using automated tools
Your Data
You retain ownership of all expense data, transaction records, and personal information you enter into MARK. We do not claim ownership of your data.
Feedback
If you provide feedback, suggestions, or ideas about MARK, we may use them without obligation to compensate you.
8. Prohibited Uses
You agree NOT to use MARK for any unlawful or prohibited purpose, including:
Illegal Activities
- Money laundering or concealing illegal income
- Tax evasion or fraudulent financial reporting
- Any activity that violates Indian law or international law
Abuse & Exploitation
- Creating multiple accounts to abuse free trial periods
- Using automated tools to manipulate ad views or bypass advertisements
- Attempting to hack, breach, or exploit security vulnerabilities
- Reverse engineering the machine learning models
Harmful Content
- Uploading malicious code, viruses, or malware
- Using the App to harass, threaten, or harm others
- Sharing offensive, defamatory, or illegal content
Commercial Misuse
- Reselling or redistributing the App
- Using the App for business expense tracking without a commercial license
- Extracting data for commercial purposes (e.g., market research, data aggregation)
Consequences of Prohibited Use
Violation of these terms may result in:
- Immediate account suspension or termination
- Forfeiture of trial access
- Legal action under Indian law (IT Act, 2000)
- Reporting to law enforcement authorities
9. Disclaimer of Warranties
MARK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
No Warranty of Accuracy
We do not guarantee that:
- AI-powered expense categorization is 100% accurate
- Voice transcription is error-free (especially in noisy environments)
- Analytics and reports are suitable for tax filing or legal purposes
- Currency conversion rates are real-time or accurate
You are solely responsible for reviewing and verifying all data entered into MARK.
No Financial Advice
MARK is a tool for tracking expenses, not a financial advisory service. We do not provide:
- Investment advice or recommendations
- Tax planning or compliance guidance
- Legal or accounting services
Consult a qualified financial advisor, tax professional, or accountant for financial decisions.
No Warranty of Availability
We do not guarantee that:
- The App will be available 24/7 without interruptions
- Third-party services (Firebase, Google Drive, Gemini API) will always be operational
- The App will work on all devices or operating systems
- Updates or new features will be provided
Third-Party Services & BYOK
MARK relies on third-party services (Google, Firebase, AdMob). We are not responsible for:
- Outages or failures of third-party services
- Changes to third-party APIs or pricing
- Third-party privacy practices or data breaches
BYOK (Bring Your Own Key) Disclaimer: If you use the BYOK features (inputting your own personal API keys for Google Gemini or Groq), you are solely responsible for obtaining and maintaining your API keys. We do not control, support, or guarantee the availability, pricing, rates, limits, accuracy, or security of these third-party endpoints. Any API costs, billing charges, rate limit exhaustion, or account actions taken by third-party providers (Google, Groq) are your sole responsibility, and we are not liable for any issues arising from your use of your own API keys.
Device Compatibility
We do not guarantee compatibility with:
- Rooted or jailbroken devices
- Modified or custom Android ROMs
- Unsupported operating system versions
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, CHINMOY DUTTA SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF MARK.
No Liability for Data Loss
We are not liable for data loss due to:
- Device failure, loss, theft, or damage
- Software bugs, crashes, or corruption
- Operating system updates or factory resets
- Accidental deletion by user
- Third-party service failures (Firebase, Google Drive)
No Liability for Financial Losses
We are not liable for financial losses resulting from:
- Inaccurate expense categorization or calculations
- Missed budgets or overspending alerts
- Tax reporting errors due to incomplete or inaccurate data
- Currency conversion miscalculations
No Liability for Third-Party Services
We are not liable for issues caused by:
- Google Drive backup failures or data loss
- Firebase Authentication outages
- Google Gemini API errors or inaccuracies
- AdMob ad delivery or payment issues
Maximum Liability Cap
In no event shall our total liability to you exceed ₹1,000 INR (One Thousand Indian Rupees) or the amount you paid for the App (whichever is less).
Exclusion of Consequential Damages
We shall not be liable for:
- Indirect, incidental, or consequential damages
- Lost profits or revenue
- Business interruption
- Emotional distress
Note: Some jurisdictions do not allow exclusion of implied warranties or limitation of liability. If these limitations do not apply to you, the above exclusions may not apply.
11. Indemnification
You agree to indemnify, defend, and hold harmless Chinmoy Dutta from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your use or misuse of MARK
- Your violation of these Terms of Service
- Your violation of any law or regulation
- Your infringement of third-party rights
- Inaccurate or fraudulent data you enter into the App
- Unauthorized access to your account due to your negligence
Defense of Claims
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense. You agree to cooperate with our defense of such claims.
12. Termination
Termination by User
You may terminate your use of MARK at any time by:
- Deleting your account (Settings → Account → Delete Account)
- Uninstalling the App from your device
Upon termination, all your data will be permanently deleted (as per our Privacy Policy).
Termination by Developer
We reserve the right to suspend or terminate your account immediately, without notice, if:
- You violate these Terms of Service
- You engage in prohibited activities (see Section 8)
- Your account remains inactive for more than 1 year (DPDP Act requirement)
- We discontinue the App or services
- Required by law or court order
Effect of Termination
Upon termination:
- Your license to use MARK is revoked
- Your account and all data will be deleted
- Any active subscription benefits are forfeited upon termination
- You must uninstall the App from all devices
Survival
The following provisions survive termination:
- Intellectual Property (Section 7)
- Disclaimer of Warranties (Section 9)
- Limitation of Liability (Section 10)
- Indemnification (Section 11)
- Governing Law (Section 13)
13. Governing Law & Dispute Resolution
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Jurisdiction
You agree that any legal action or proceeding arising from these Terms or your use of MARK shall be brought exclusively in the courts of India. You consent to the personal jurisdiction of such courts.
Dispute Resolution Process
- Informal Resolution (First Step): Contact us at dattatechom@gmail.com to resolve disputes amicably. We will respond within 48 hours.
- Mediation (Second Step): If informal resolution fails, disputes may be submitted to mediation under the Mediation Act, 2023 (India).
- Arbitration (Third Step): If mediation fails, disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with arbitration conducted in English.
- Litigation (Last Resort): If arbitration is not applicable or enforceable, disputes shall be resolved in Indian courts.
Class Action Waiver
You agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class action or representative proceeding.
Time Limit for Claims
Any claim arising from these Terms or your use of MARK must be filed within 1 year from the date the claim arose. Claims filed after 1 year are permanently barred.
14. Modifications to Terms
Right to Modify
We reserve the right to modify these Terms of Service at any time. Changes may be made to:
- Reflect new features or services
- Comply with legal or regulatory requirements
- Address user feedback or security concerns
Notification of Changes
When we modify these Terms, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via in-app notification or email
- For material changes, require you to accept the new Terms before continuing to use the App
Acceptance of Modified Terms
By continuing to use MARK after changes to these Terms, you accept the updated Terms. If you do not agree, you must stop using the App and delete your account.
